1. Acceptance of Terms

Welcome to Botlist. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

Botlist provides bot traffic detection and management services for advertising platforms including Google Ads, Facebook Ads, and TikTok Ads. Our service analyzes Cloudflare log data to identify suspicious bot activity and enables automated suppression of bot IP addresses in your advertising campaigns.

2. Description of Service

Botlist offers the following core services:

  • Bot Traffic Analysis: Collection and analysis of Cloudflare log data to identify bot traffic patterns
  • Report Generation: Detailed IP-level and bot behavior reports with suppression recommendations
  • IP Suppression: Automated blocking of suspicious IP addresses in connected advertising platforms
  • Integration Management: OAuth-based connections to Google Ads, Facebook Ads, and TikTok Ads accounts
  • Campaign Management: Selective or bulk application of IP exclusions across advertising campaigns

3. User Accounts and Registration

To use Botlist, you must:

  • Register for an account with accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have the legal authority to bind your organization to these Terms
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Advertising Platform Integration

4.1 Google Ads Integration

When you connect your Google Ads account, you acknowledge that:

  • You authorize Botlist to access your Google Ads account data via OAuth 2.0
  • Botlist will add IP exclusions to your campaigns based on bot detection analysis
  • You comply with the Google Ads API Terms and Conditions
  • You maintain a valid privacy policy as required by Google's API Services User Data Policy
  • We use your data only for providing bot suppression services and as permitted by Google's policies

4.2 Facebook/Meta Ads Integration

When you connect your Facebook Ads account, you acknowledge that:

  • You authorize Botlist to create and manage Custom Audiences for bot exclusion purposes
  • Botlist may install tracking pixels on your monitored websites for bot detection
  • You comply with Meta's Business Products (Data) Terms
  • You have obtained proper consent from users as required by GDPR, CCPA, and other applicable privacy laws
  • Contact information (emails, phone numbers) will be hashed before transmission to protect privacy

4.3 TikTok Ads Integration

When you connect your TikTok Ads account, you acknowledge that:

  • You authorize Botlist to create and manage Custom Audiences for bot exclusion purposes
  • You comply with TikTok's Business Products (Data) Terms
  • You have provided clear notice to users regarding data collection via Device Data Collection Tools (DDCTs)
  • You comply with applicable data protection laws including GDPR, LGPD, CCPA, and other jurisdictional requirements
  • Contact details will be hashed prior to transmission to protect user privacy

4.4 Your Responsibilities

When using advertising platform integrations, you must:

  • Obtain and maintain valid user consent for data collection and sharing as required by law
  • Maintain an up-to-date privacy policy that accurately describes data collection and usage
  • Monitor automated IP suppression actions to ensure they align with your advertising goals
  • Comply with all platform-specific policies and guidelines
  • Not use our service to circumvent platform policies or engage in fraudulent activity

5. Data Collection and Usage

Botlist collects and processes the following types of data:

  • Cloudflare Log Data: IP addresses, bot scores, geolocation data, user agents, request metadata
  • Advertising Platform Data: Campaign information, account details, suppressed IP lists
  • User Account Data: Email addresses, organization information, user preferences
  • Analytics Data: Service usage patterns, report generation history, API interactions

We use this data exclusively to:

  • Provide bot detection and IP suppression services
  • Generate reports and analytics about bot traffic patterns
  • Improve our service performance and accuracy
  • Comply with legal obligations and platform requirements

6. Service Limitations and Disclaimers

6.1 No Guarantee of Results

While Botlist uses sophisticated algorithms to detect bot traffic, we do not guarantee:

  • 100% accuracy in bot detection (false positives and false negatives may occur)
  • Specific improvements in advertising performance or ROI
  • Complete elimination of all bot traffic from your advertising campaigns
  • Continuous availability of third-party advertising platform APIs

6.2 Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect availability. We are not liable for any losses resulting from service downtime.

6.3 Third-Party Platform Dependencies

Our service depends on third-party APIs (Google Ads, Facebook Ads, TikTok Ads). Changes to these APIs, policy updates, or access restrictions may affect our service functionality. We will make reasonable efforts to adapt to such changes but are not responsible for disruptions caused by third-party platforms.

7. User Conduct and Prohibited Uses

You agree NOT to:

  • Use the service to violate any laws, regulations, or third-party rights
  • Attempt to circumvent security measures or access unauthorized data
  • Reverse engineer, decompile, or disassemble any part of the service
  • Use the service to distribute malware, spam, or harmful content
  • Interfere with or disrupt the service or servers
  • Create multiple accounts to abuse free trial periods or pricing tiers
  • Share account credentials with unauthorized users
  • Use automated tools to scrape or extract data from the service
  • Violate advertising platform policies or terms of service

8. Intellectual Property Rights

Botlist and its original content, features, and functionality are owned by Botlist and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of your data (domains, log entries, integration configurations). By using our service, you grant us a limited license to process your data solely for providing the service.

9. Payment and Billing

If applicable to your subscription plan:

  • Fees are billed in advance on a recurring basis (monthly or annually)
  • You authorize us to charge your payment method for all fees owed
  • Fees are non-refundable except as required by law or stated in our refund policy
  • We may change pricing with 30 days' notice to existing customers
  • Failure to pay may result in service suspension or account termination

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Non-payment of fees
  • Violation of advertising platform policies
  • Suspected fraudulent or illegal activity

Upon termination:

  • Your right to access and use the service will immediately cease
  • You may request export of your data within 30 days
  • We may delete your data after 90 days unless legally required to retain it
  • Outstanding fees remain due and payable

You may terminate your account at any time through the account settings or by contacting support.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Botlist is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not responsible for losses due to bot detection errors, API failures, or service interruptions

12. Indemnification

You agree to indemnify and hold harmless Botlist, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of advertising platform policies
  • Your failure to obtain proper user consent for data collection

13. Data Protection and Privacy Compliance

Both parties agree to comply with applicable data protection laws, including GDPR, CCPA, LGPD, and other jurisdictional privacy regulations.

As a data processor, we will:

  • Process personal data only on your documented instructions
  • Implement appropriate technical and organizational security measures
  • Assist with data subject requests (access, deletion, portability)
  • Notify you of data breaches within 72 hours of discovery
  • Delete or return personal data upon termination as requested

As a data controller, you must:

  • Obtain lawful consent from users for data collection and processing
  • Maintain an accurate privacy policy accessible to users
  • Honor user rights requests (access, deletion, opt-out)
  • Only share data you have lawful authority to share

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via:

  • Email notification to your registered email address
  • Prominent notice on our website
  • In-app notification upon login

Your continued use of the service after changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the service and may terminate your account.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the service shall be resolved through:

  1. Good faith negotiation between the parties
  2. Binding arbitration if negotiation fails (JAMS rules apply)
  3. Arbitration shall be conducted in California unless otherwise agreed

You agree to waive any right to a jury trial or participation in class action lawsuits.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Botlist.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service provider failures.

18. Platform-Specific Compliance

18.1 Google Ads API Compliance

This application uses the Google Ads API and is subject to the Google Ads API Terms and Conditions. By using this service, you acknowledge that:

  • Botlist accesses your Google Ads data solely to provide bot suppression services
  • We comply with Google's API Services User Data Policy regarding data handling
  • We may inspect API Client user interfaces and monitor API activity for quality assurance
  • Your use of our service must comply with all applicable Google Ads policies

18.2 Meta/Facebook Ads Compliance

By connecting your Facebook/Meta Ads account, you acknowledge compliance with:

  • Meta Custom Audiences Terms
  • Meta Business Tools Terms
  • GDPR requirements for custom audience creation and management
  • Proper consent mechanisms for tracking pixel implementation

18.3 TikTok Ads Compliance

By connecting your TikTok Ads account, you acknowledge compliance with:

  • TikTok Business Products (Data) Terms
  • TikTok Developer Terms of Service
  • Applicable data protection laws (GDPR, LGPD, CCPA, etc.)
  • Contact hashing requirements for privacy protection
